Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer" or "you") and Ecomerco – Jakub Janus, a sole proprietorship registered in Poland ("Lumistate", "we", "us", or "our"), governing your access to and use of the Lumistate platform and related services.
1. Service Provider & Acceptance
1.1 Provider Identification. The Service is operated by:

1.2 Acceptance. By accessing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
1.3 Authority. You represent that you are at least 18 years old and have the legal authority to enter into these Terms. If you are entering into these Terms on behalf of a company, brokerage, MLS organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and "Customer" refers to that entity.
1.4 Business Use. The Service is intended for business use by real estate professionals, brokerages, photographers, and MLS organizations. The Service is not intended for personal, family, or household use.
2. Definitions
For the purposes of these Terms:
- "Account" means the registered Customer account used to access the Service.
- "Content" means photos, images, listing information, descriptions, metadata, and other materials uploaded by Customer.
- "Output" means processed images, generated descriptions, and other AI-produced materials returned to Customer.
- "Service" means the Lumistate platform, including all features, tools, APIs, integrations, and documentation.
- "Subscription Fees" means the recurring fees payable for access to paid plans.
- "Sub-processor" means a third-party service provider engaged by Lumistate to process Content as part of providing the Service.
3. Description of Service
3.1 Service Components. Lumistate provides AI-powered real estate workflow services, including but not limited to:
- HDR enhancement and tone mapping
- Virtual staging in multiple style presets
- Sky replacement and exterior optimization
- AI-generated listing descriptions in supported languages
- In-paint and object removal
- Privacy blur for faces, license plates, and personal identifiers
- 360° tour generation
- AI video generation (subject to credit packs)
- MLS-ready exports with auto-disclosure capabilities (per applicable jurisdiction)
- API integrations and white-label deployment (per partnership tier)
- Compliance tooling for AB 723, GDPR, and other regulatory frameworks
3.2 Service Modifications. We may add, modify, or discontinue features at any time. Material changes affecting paid plans will be communicated per Section 24.
3.3 Beta Features. Some features may be designated as "beta" or "preview." Beta features are provided as-is, may be modified or removed at any time, and are excluded from any service availability commitments.
4. Account Registration & Security
4.1 Registration. You must register an account with accurate, current, and complete information. You agree to update your account information as needed to keep it accurate.
4.2 Credentials. You are responsible for safeguarding your login credentials and for all activity that occurs under your Account. You must notify us immediately at jakub@amaia-estate.com of any unauthorized access or security breach.
4.3 No Sharing. You may not share Account credentials with third parties, except authorized users within your organization for plans that permit team access (Business and partnership tiers). Each authorized user must comply with these Terms.
4.4 Suspension for Security. We may suspend Account access if we reasonably believe credentials have been compromised, until the situation is resolved.
5. Subscriptions, Billing, and Payments
5.1 Subscription Plans. Paid plans are described on lumistate.ai/pricing and are subject to the photo quotas and feature sets specified for each plan.
5.2 Billing Cycle. Subscription Fees are billed in advance on a recurring monthly basis via Stripe, our payment processor. Annual prepayment options may be offered for certain plans.
5.3 Payment Authorization. By providing payment details, you authorize us (and Stripe) to charge the recurring Subscription Fees and any applicable taxes to your designated payment method until you cancel.
5.4 Currency and Taxes. Prices are displayed in your local currency where supported (EUR, USD, GBP). Prices are exclusive of applicable taxes (VAT, GST, sales tax) unless explicitly stated. Taxes will be added at checkout based on your billing address.
5.5 Pricing Changes. We may change Subscription Fees with at least 30 days' prior notice. Changes will not affect your current billing cycle. You may cancel before the new pricing takes effect.
5.6 Failed Payments. If a payment fails, we will attempt to charge again over the following 7 days. If payment cannot be collected, we may suspend or terminate your Account.
5.7 No Refunds for Partial Periods. Subscription Fees are non-refundable for partial billing periods, except as required by applicable consumer protection law (see Section 21 for EU consumers).
5.8 Add-Ons. AI Video credit packs and other one-time purchases are non-refundable once consumed and expire 12 months after purchase if unused.
6. Free Trial & Refund Policy
6.1 Free Trial. New Accounts may be eligible for a free tier offering a limited number of photos per month at no charge. Free tier users are subject to these Terms.
6.2 Pro Tier Trial. Where offered, paid-plan trials convert to active subscriptions at the end of the trial period unless cancelled before expiration.
6.3 EU Consumer Withdrawal Right. EU consumers have a 14-day right of withdrawal under EU Consumer Rights Directive (Section 21). Business customers and professional users acting in their commercial capacity (which includes most real estate agents) may not have these rights.
6.4 Refunds at Lumistate's Discretion. Outside statutory rights, refunds may be issued at our sole discretion in cases of demonstrable service failure or billing error.
7. Photo Usage, Quotas, and Storage
7.1 Monthly Quota. Each plan includes a specified monthly photo processing quota. Quotas reset on the monthly billing date.
7.2 No Rollover. Unused photos do not roll over to the next billing period. We do not refund or credit unused quota.
7.3 Quota Exhaustion. Once monthly quota is reached, processing is blocked until: (a) the next billing cycle, (b) a plan upgrade, or (c) purchase of additional photo credits where available.
7.4 Storage. Processed listings and original photos are retained for 90 days by default for paid plans (7 days for free tier). Customers may extend retention via paid storage upgrades or download originals at any time.
7.5 Share Links. Share links for client approval expire after 7 days unless explicitly extended. Expired links cannot be reactivated.
7.6 Volume Spikes. We reserve the right to throttle or rate-limit processing during periods of unusual demand or suspected abuse, subject to fair usage principles.
8. Intellectual Property — Customer Content
8.1 Customer Ownership. You retain all right, title, and interest in and to your Content. We do not claim ownership of any Content you upload or any Output we deliver.
8.2 License to Lumistate. You grant Lumistate a limited, non-exclusive, worldwide, royalty-free license to access, store, copy, transmit, modify, and process your Content solely for the purposes of:
- Delivering the Service to you
- Performing technical operations (backup, format conversion, etc.)
- Improving Service quality through aggregated, de-identified analytics
- Complying with legal obligations
8.3 No Training on Your Content. We do not use your Content to train AI models. Customer Content is processed for your specific use case and not retained for model improvement, fine-tuning, or any other AI training purpose, except as explicitly opted in.
8.4 Output Ownership. You own all Output produced by the Service from your Content, subject to:
- Lumistate's underlying technology (Section 9)
- Third-party model outputs whose ownership is governed by underlying provider terms (e.g., Google Gemini, Veo)
8.5 License Termination. The license granted in Section 8.2 terminates when you delete the Content, terminate your Account, or when retention periods expire (whichever is earliest).
8.6 Customer Representations. You represent and warrant that:
- You own or have all necessary rights to upload the Content
- The Content does not infringe any third-party rights
- The Content does not violate any law in the jurisdictions where you operate
- You have all necessary consents from individuals whose images appear in the Content (or from property owners regarding interior photos)
9. Intellectual Property — Lumistate Property
9.1 Lumistate Ownership. All right, title, and interest in and to the Service, including the platform, software, AI models (where proprietary), trademarks, logos, documentation, and all related intellectual property, are owned by Lumistate or its licensors.
9.2 Limited License to You. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your business purposes during your active subscription.
9.3 Restrictions. You may not:
- Copy, modify, or create derivative works of the Service
- Reverse-engineer, decompile, or disassemble the Service
- Remove proprietary notices or labels from Output
- Use the Service to build a competing product
- Resell, sublicense, or commercially exploit access to the Service without explicit written authorization
9.4 Feedback. If you provide feedback, suggestions, or feature requests, you grant Lumistate a perpetual, royalty-free license to incorporate that feedback without obligation.
10. AI Services & Model Outputs
10.1 Nature of AI Output. The Service uses artificial intelligence models to process Content. AI models are probabilistic systems that may produce errors, inaccuracies, or unexpected results. You acknowledge that:
- AI Output is not guaranteed to be accurate, error-free, or fit for any particular purpose
- Output quality depends on input quality, model state, and other factors
- The same input may produce different Output across processing instances
- Hallucinations, omissions, or misrepresentations may occur despite our safeguards
10.2 Customer Verification Obligation. You are responsible for reviewing and verifying all Output before publishing, distributing, or relying on it. Lumistate is not responsible for misrepresentations in real estate listings caused by Output that you publish without adequate review.
10.3 MLS and Disclosure Compliance. Although our Service includes compliance tooling for jurisdictions like California (AB 723) and the EU (AI Act), you remain solely responsible for ensuring that your listings comply with applicable MLS rules, disclosure requirements, and real estate regulations in your jurisdiction.
10.4 No Guarantee of Compliance Outcomes. Compliance features are tools that assist you in meeting regulatory obligations. They do not guarantee regulatory acceptance, MLS approval, or freedom from civil claims. You should consult qualified legal counsel for compliance matters in your specific jurisdiction.
10.5 Third-Party AI Models. Some features rely on third-party AI providers (Google Gemini, Google Veo, etc.). Your use of these features is subject to those providers' terms in addition to these Terms. We may change underlying providers at any time without notice.
10.6 Sub-Processor Disclosure. Current AI sub-processors include but are not limited to:
- Google (Gemini, Veo) — for AI description generation and video generation
- Stripe — for payment processing
- Supabase — for database and authentication infrastructure
- Cloudflare — for content delivery and security
A current list of sub-processors is available at lumistate.ai/legal/sub-processors and updates with at least 30 days' notice for material changes.
11. Acceptable Use
11.1 Prohibited Uses. You may not use the Service to:
- Upload Content that is illegal, defamatory, obscene, harassing, or violates any law
- Upload Content that infringes intellectual property, privacy, publicity, or other rights
- Generate, publish, or distribute Output intended to defraud, deceive, or materially misrepresent property characteristics
- Violate MLS rules, real estate disclosure requirements, or consumer protection laws
- Generate content depicting individuals without consent (where consent is required)
- Circumvent any technical limitations, security measures, or rate limits
- Access the Service via automated means (bots, scrapers) except via official APIs
- Resell, redistribute, or commercialize Output as a stand-alone product (you may use Output in your real estate listings, marketing materials, and communications)
- Use the Service for any purpose competitive with Lumistate
11.2 Real Estate-Specific Restrictions. You may not use the Service to:
- Misrepresent the physical state of a property in ways that mislead buyers
- Generate or distribute photos that violate Article 12 of the NAR Code of Ethics
- Use AI-altered photos in jurisdictions requiring disclosure without applying the appropriate disclosure (Lumistate provides tooling; you must use it)
11.3 Enforcement. Violations may result in immediate suspension or termination of your Account, deletion of offending Content, and reporting to applicable authorities. Repeated or serious violations void your right to refunds under any policy.
12. Customer Representations & Warranties
You represent, warrant, and covenant that:
12.1 You have the legal authority to enter into these Terms.
12.2 All information you provide is accurate and you will keep it accurate.
12.3 You own or have all necessary rights to upload the Content you upload.
12.4 Your use of the Service complies with all applicable laws, regulations, and professional standards (including MLS rules, real estate licensing requirements, and consumer protection laws in your jurisdiction).
12.5 You will obtain all necessary consents from individuals appearing in your Content.
12.6 You will not use the Service in any manner that could damage, disable, overburden, or impair our systems or interfere with other users.
12.7 Your use does not violate any agreement you have with any other party (including your brokerage, MLS, or photographer agreements).
13. Lumistate Representations & Disclaimers
13.1 Limited Representations. Lumistate represents that:
- We will provide the Service in a professional manner
- We will use commercially reasonable efforts to maintain Service availability
- Our processing of your Content will follow our Privacy Policy
13.2 NO OTHER WARRANTIES. EXCEPT AS EXPLICITLY STATED IN SECTION 13.1 AND TO THE EXTENT PERMITTED BY APPLICABLE LAW: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." LUMISTATE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF OUTPUT
- UNINTERRUPTED OR ERROR-FREE OPERATION
- COMPLIANCE OF OUTPUT WITH ANY SPECIFIC REGULATORY FRAMEWORK BEYOND TOOLING DESIGNED FOR THAT PURPOSE
13.3 No Legal or Regulatory Advice. Lumistate is not a law firm. Compliance tooling does not constitute legal advice. You should consult qualified counsel for legal matters in your jurisdiction.
14. Service Availability & Absence of SLA
14.1 No SLA for Self-Serve Plans. Free, Pro, Volume Pro, and Business plans are provided without a formal Service Level Agreement (SLA). We use commercially reasonable efforts to maintain uptime, but do not commit to specific uptime percentages or response times for these tiers.
14.2 Partnership-Tier SLAs. Brokerage and MLS partnership tiers may include written SLAs covering uptime, response times, and remediation. Such SLAs are negotiated separately and form part of the executed partnership agreement.
14.3 Maintenance Windows. We may schedule maintenance with reasonable advance notice. Emergency maintenance may occur without notice.
14.4 Force Majeure. Service interruptions caused by force majeure events are not breaches of these Terms (Section 23.2).
15. Data Retention, Deletion, & Sub-Processors
15.1 Default Retention. Processed Content is retained for 90 days from processing date for paid plans (7 days for free tier). Original Content is retained for the same period unless you elect otherwise.
15.2 AB 723 Compliance Retention. For Customers using AB 723 compliance features, original Content and full audit logs are retained for 7 years after the listing date, in compliance with California's statute of limitations for relevant claims. This extended retention applies only to Content marked as AB 723–compliant.
15.3 Customer-Initiated Deletion. You may delete your Content at any time via the Service interface. Deletion is processed within 30 days. Some technical backups may persist for additional 30 days due to disaster recovery requirements before being purged.
15.4 Termination Deletion. Upon Account termination, all Content is scheduled for deletion within 60 days, except where retention is required by law (e.g., AB 723 compliance, tax records).
15.5 Data Export. Before deletion, you may export your Content via the Service interface or by request to jakub@amaia-estate.com.
15.6 Sub-Processors. We engage sub-processors to deliver the Service. The current list is at lumistate.ai/legal/sub-processors. We will provide 30 days' notice before adding new sub-processors that materially process Content.
16. Privacy & Data Protection
16.1 Privacy Policy. Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference.
16.2 GDPR. For Customers and end users in the European Economic Area, the United Kingdom, and Switzerland, processing is conducted in accordance with the General Data Protection Regulation (GDPR) and applicable national laws. A Data Processing Agreement (DPA) is available upon request for B2B customers.
16.3 CCPA. For California residents, processing is conducted in accordance with the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). California-specific disclosures are in Section 22.
16.4 Data Transfers. Some Content may be processed outside your country of residence. We implement appropriate safeguards (Standard Contractual Clauses, adequacy decisions where applicable) for cross-border transfers.
16.5 Personal Data in Photos. You acknowledge that photos may contain personal data (faces, license plates, identifiable home interiors). You are responsible for any required consents. Our auto-blur feature is a tool to assist compliance, not a guarantee of regulatory compliance.
17. Indemnification
17.1 Customer Indemnification. You agree to defend, indemnify, and hold harmless Lumistate and its officers, employees, agents, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your Content (including its accuracy, ownership, and lawfulness)
- Your use of the Service in violation of these Terms or applicable law
- Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
- Misrepresentations in your real estate listings, regardless of whether you used Output without review
- Claims by sellers, buyers, or other agents arising from your use of the Service
- Your violation of MLS rules, real estate licensing requirements, or consumer protection laws
17.2 Lumistate Indemnification. Lumistate will defend, indemnify, and hold harmless Customer from third-party claims that the Service, when used as permitted by these Terms, infringes that third party's intellectual property rights. This obligation does not apply to claims arising from:
- Customer Content
- Customer's modifications of the Service
- Customer's use of the Service in violation of these Terms
- Combinations of the Service with non-Lumistate products or services
17.3 Procedure. The indemnified party must: (a) promptly notify the indemnifying party of the claim, (b) give the indemnifying party sole control of the defense and settlement, and (c) cooperate reasonably in the defense.
18. Limitation of Liability
18.1 EXCLUSION OF INDIRECT DAMAGES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER PARTY SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:
- LOST PROFITS OR REVENUE
- LOST BUSINESS OPPORTUNITIES
- LOSS OF DATA
- LOSS OF GOODWILL
- COMMISSION CLAIMS BY THIRD PARTIES
- COSTS OF SUBSTITUTE SERVICES
REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE) AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
18.2 AGGREGATE CAP. TO THE FULLEST EXTENT PERMITTED BY LAW, LUMISTATE'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (a) THE AMOUNT YOU PAID TO LUMISTATE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED EURO (€100).
18.3 Limitations on Limitations. The limitations in Sections 18.1 and 18.2 do not apply to:
- Liability that cannot be limited under applicable law (e.g., gross negligence, intentional misconduct, fraud, or harm to life and health under EU law)
- Customer's payment obligations
- Customer's indemnification obligations under Section 17.1
- Either party's indemnification of intellectual property claims under Section 17.2
18.4 Essential Basis. The parties acknowledge that the limitations in this Section 18 are an essential basis of the bargain and that the Subscription Fees reflect this allocation of risk.
18.5 Consumer Protections. Nothing in these Terms limits liability for damages that cannot be excluded under applicable consumer protection law (Section 21).
19. Termination & Suspension
19.1 Customer Termination. You may terminate your Account at any time by canceling your subscription via the Service interface. Termination takes effect at the end of the current billing period.
19.2 Lumistate Termination for Convenience. We may terminate paid plans with at least 30 days' notice. We will issue a pro-rata refund of any prepaid Subscription Fees for unused service.
19.3 Lumistate Termination for Cause. We may suspend or terminate your Account immediately for:
- Material breach of these Terms (including non-payment after the 7-day grace period in Section 5.6)
- Suspected fraudulent activity
- Violations of acceptable use (Section 11)
- Legal obligation requiring termination
- Posing an unreasonable security or liability risk
Termination for cause does not entitle you to a refund.
19.4 Effect of Termination. Upon termination:
- Your right to use the Service ceases
- Content deletion follows Section 15
- All payment obligations remain due
- Sections that by their nature should survive (Sections 8, 9, 10.2, 13.2, 17, 18, 20, 23) survive termination
19.5 No Penalties. Termination is not by itself a breach of these Terms.
20. Governing Law & Dispute Resolution
20.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict-of-law principles.
20.2 Jurisdiction. Subject to Section 20.3, any dispute arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts having jurisdiction over Jawor, Poland.
20.3 EU Consumer Forum. EU consumers may bring claims in the courts of their country of residence to the extent provided by EU consumer protection law. EU consumers also have access to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
20.4 Informal Resolution First. Before initiating formal proceedings, the parties agree to attempt good-faith resolution through direct communication for at least 30 days from the date of written notice of the dispute.
20.5 Optional Arbitration. For B2B customers and partnership-tier customers, the parties may agree in writing to submit disputes to arbitration under the rules of the [International Chamber of Commerce / Polish Court of Arbitration — to be confirmed by counsel] in lieu of court proceedings.
21. EU Consumer Rights
21.1 Consumer Status. This Section applies only to "consumers" as defined under EU law (natural persons acting outside their trade, business, craft, or profession). Most users of the Service are professional users (real estate agents acting in their business capacity) and therefore not consumers.
21.2 Right of Withdrawal. EU consumers have the right to withdraw from these Terms within 14 days of acceptance, without giving any reason, except where the consumer has expressly requested immediate performance of services and acknowledges loss of withdrawal rights upon full performance.
21.3 Withdrawal Procedure. To exercise withdrawal, send a clear statement to jakub@amaia-estate.com.
21.4 Statutory Rights Preserved. Nothing in these Terms limits or excludes EU consumer statutory rights, including:
- Rights under EU Consumer Rights Directive 2011/83/EU
- Rights under EU Directive 93/13/EEC on unfair contract terms
- Rights under EU GDPR
- Rights under national consumer protection laws
21.5 Conflict. If any provision of these Terms conflicts with mandatory consumer protection law, the mandatory law prevails for EU consumers, and the rest of these Terms remain in effect.
22. California-Specific Provisions
22.1 California Customers. If you are a California resident or your real estate business operates in California, this Section applies in addition to other Terms.
22.2 AB 723 Acknowledgment. California Assembly Bill 723 requires disclosure of digital alterations to listing photos under specified conditions. Lumistate's Service includes tooling to assist with AB 723 compliance, but you retain sole responsibility for ensuring compliance with AB 723 and all other California real estate laws and regulations applicable to your listings.
22.3 CCPA Rights. California residents have rights under the CCPA/CPRA, including the right to know, delete, correct, and limit use of personal information. To exercise these rights, contact jakub@amaia-estate.com or use the privacy controls described in our Privacy Policy.
22.4 Sale of Personal Information. Lumistate does not sell personal information as defined under the CCPA.
22.5 California Notice for Out-of-State Operators. Ecomerco – Jakub Janus is a Polish entity. By using the Service, California residents consent to the processing of their personal information outside California (including transfers to Poland and the EU) in accordance with our Privacy Policy and Standard Contractual Clauses where applicable.
23. General Provisions
23.1 Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to (a) an affiliate, (b) a successor in connection with a merger, acquisition, or sale of substantially all assets, or (c) any successor entity, with notice to you.
23.2 Force Majeure. Neither party is liable for failure or delay caused by events beyond reasonable control, including acts of God, war, terrorism, civil unrest, government action, pandemic, internet failures, electrical failures, or service disruptions of upstream providers (including Stripe, Google, Cloudflare, Supabase, or other sub-processors).
23.3 Notices. Notices to Lumistate must be in writing to jakub@amaia-estate.com. Notices to Customer will be sent via email to the address on file or through the Service interface.
23.4 Severability. If any provision is held unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions remain in full force.
23.5 Survival. Sections 8 (Customer Content), 9 (Lumistate Property), 10.2 (Customer Verification), 13.2 (Disclaimers), 17 (Indemnification), 18 (Limitation of Liability), 20 (Governing Law), and 23 (General Provisions) survive termination.
23.6 No Waiver. Failure to enforce any provision is not a waiver of future enforcement.
23.7 Independent Contractors. The parties are independent contractors. These Terms do not create any partnership, joint venture, employment, or agency relationship.
23.8 No Third-Party Beneficiaries. These Terms do not create any rights for third parties, except as expressly stated.
23.9 Entire Agreement. These Terms, together with the Privacy Policy and any executed partnership agreement or DPA, constitute the entire agreement between the parties regarding the Service and supersede all prior agreements.
23.10 Order of Precedence. In case of conflict: (a) executed partnership agreements or DPAs prevail over (b) these Terms, which prevail over (c) the Privacy Policy on matters of contract interpretation, and over (d) marketing materials.
23.11 Language. These Terms are provided in English. Where translations are provided for convenience, the English version controls in case of conflict, except where applicable law requires otherwise.
24. Changes to Terms
24.1 Material Changes. We may modify these Terms. For material changes affecting your rights or obligations, we will provide at least 14 days' notice via email and/or in-app notification before changes take effect.
24.2 Non-Material Changes. Non-material changes (e.g., clarifications, formatting updates) take effect upon posting.
24.3 Acceptance. Continued use of the Service after the effective date of changes constitutes acceptance. If you do not accept material changes, you must stop using the Service before the effective date.
24.4 Version History. We maintain a version history of material changes at lumistate.ai/legal/terms-history (or available on request).
